Examples of changes to mobile and internet accounts

Σenters into force on 1 January 2019, the third and final adjustment step provided in the Regulation of General Licenses of EETT. The Regulation defines the obligations of electronic communications providers, with the aim of protecting the rights of subscribers to telephony and Internet.

Specifically, with the third stage, the following regulations are imposed:

Automatic cessation of services to avoid over-indebtedness: At the conclusion of the contract and to avoid over-indebtedness, the subscribers will be able to choose the possibility of automatic termination of the service, whenever the account exceeds a certain maximum, based on at least three options.

Maximum amount of the fee for early termination of a fixed-term contract: The way in which the maximum amount of the fee for the termination of a fixed-term contract before its expiration will be calculated is precisely determined.

Seamless access to contract terms and price lists: Providers should ensure that subscribers have easy access to information about the current terms of the contract and the price list of services, as well as any changes.

In particular, at the conclusion of the contract and in order to avoid over-indebtedness, the subscribers will be able to choose the possibility of automatic termination of service, whenever the account exceeds a certain ceiling, based on at least three options. At least one of these options should not exceed (in terms of the final amount of the bill) 150 euros, if a monthly billing cycle is followed, and 300 euros, in cases where a bi-monthly billing cycle is followed.

Maximum amount of early termination fee

In case of termination of a fixed-term contract before its expiration, the termination fee should not exceed the following two amounts (A and B):

Amount A

  • The total amount that will result from the sum of the following:
  • The total discount on the monthly fee until the moment of termination.

The remaining amortization amount for any device, equipment or line construction subsidy.

Please note that if the subscriber terminates the contract at any time before 2 months have elapsed from the start, he / she will have to pay:

The fixed assets of 2 months.

The 2-month discount and the remaining, beyond 2 months, amortization amount for any subsidy of device, equipment or line construction.

Amount B

The total amount that will result from the sum of the following:

  • 1/3 of the total monthly fixed assets for the period from the date of termination to the estimated expiration date of the fixed-term contract.
  • The amount of depreciation for any device, terminal equipment or line construction subsidy, which corresponds to 2/3 of the remaining period from the date of termination to the estimated expiration date of the contract. the early termination fee that the subscriber will have to pay, on a case by case basis and for each month of termination.

Example: Subscriber enters into a contract lasting 24 months, with an initial price of a monthly fixed fee of 40 euros and a discount of 10 euros (ie a final price of 30 euros), as well as a subsidy of 96 euros for the purchase of a device. The subsidy of the device is depreciated by 4 euros / month.

Case 1: The subscriber decides to terminate the contract at the end of the 15th month, ie 9 months before its expiration. The amount A amounts to 186 euros (ie the total discount corresponding to 15 months, plus the remaining amount for the amortization of the grant until the end of the contract). The amount B amounts to 114 euros (1/3 of the remaining assets, plus the amount of grant amortization for 2/3 of the remaining period of 9 months). Therefore, since the amount B is the smallest, the contract termination fee that will be charged to the subscriber should not exceed 114 euros (see table, Case 1).

Case 2: The subscriber decides to terminate the contract during the first month of the contract. In this case, he must pay the provider a total amount of 168 euros, ie the fixed assets and the discount corresponding to 2 months, plus the remaining amount - beyond 2 months - for the amortization of the subsidy (see table, Case 2).

 

Providers will have the obligation to inform subscribers and provide easy access to information posted on their website, regarding the applicable terms of the contract and the price list of services. Also, any modifications should be highlighted. The above information should remain posted on the provider's website for up to two years after its removal, with reference to the period for which it was valid.
