Italian data protection regulator has launched a lawsuit against TikTok, claiming that the Chinese video-sharing application violates privacy, especially of minors.
Η This development follows the establishment of a task force to investigate TikTok's data protection practices. European Data Protection Council (EDPB), earlier in the year and at the request of the Italian regulatory authority, also known as Guarantee.
The application is also under investigation by privacy regulators in the Netherlands, Denmark, France and the United Kingdom.
In a statement on Tuesday, Garante said it was launching its own formal action against TikTok despite ongoing work at European level due to the urgent need to protect Italian minors. The agency said its investigation found that the ban on enrollment in TikTok for people under 13 is easily bypassed and that user information is very general and not specific enough for children.
The Italian regulator also accused the Chinese application of lack of clarity about how long it has been keeping data and for what purposes, what methods it uses to protect anonymity, as well as what happens to data sent to non-EU countries.
Garante's intervention underscores the confusion over the regulations governing the operation of TikTok in Europe. Although the app moved key data protection features to Dublin in July, in order to make Irish Data Protection Commission (DPC) as its main regulator under EU rules, the DPC itself has challenged this move.
It is noted that TikTok will have 30 days to file objections and possibly request a hearing.
