EU: Complains China to World Trade Organization for patent infringement

Η European Union filed a protest against China in World Trade Organization (WTO) for patents.


Η  European Union claimed that European telecommunications patent holders (e.g. 5G networks) have no power to take legal action to protect their rights in Chinese courts.

Η EU reports that many Chinese companies are exploiting European patents without asking permission or paying compensation to the holders. The latter, in fact, not only can not file lawsuits in China, but are prevented from going to foreign courts because they are threatened with hefty fines that can reach up to € 130.000 per day.

As is logical, the EU Stresses that these practices are detrimental to the innovation and development of European technology companies, but also of the Member States, while noting that it has approached its counterparts in China many times in the past to find a solution, but to no avail.

With this protest to World Trade Organization, the EU will call for a committee to resolve this dispute if no compromise is reached with China within the next 60 days. Now we do not know exactly what this commission will be able to achieve, but it may be able to push for retaliation against Chinese companies. (eg embargo).
