Commission: Pay TV piracy is in the spotlight - What is the case in Greece

To her target European Commission enters the piracy of sports and other live events on a large commercial scale, such as concerts and theatrical performances, in an effort to protect intellectual property


For this reason, Ευρωπαϊκή Επιτροπή it proceeded last week to issue a recommendation on combating the phenomenon, encouraging member states, their national authorities, rights holders and intermediary service providers to take effective, balanced and appropriate measures.

The establishment of the Commission

In particular, the relevant recommendation focuses on three main areas, the timely processing of notices related to live events, dynamic temporary injunctions and commercial offers and public awareness.

In the first case, based on the digital services act, it is emphasized the importance of urgent action by hosting service providers in order to minimize the harm caused by illegal streaming.

Concerning dynamic temporary orders and in accordance with the remedies provided for in the Directive on the enforcement of intellectual property rights, the recommendation encourages the use of temporary restraining orders tailored to live events. As for live sporting events, are encouraged member states to grant to organizers them legitimate interest for to seek interim injunctions where this is not currently possible.

Finally, it is also recommended to organizers of sports and other live events, as well as to broadcasters, to increase the availability, affordability and attractiveness of their commercial offers to end-users across the Union. Member States are called upon to raise awareness among consumers about the legal offers that exist to enjoy this type of content, as well as among law enforcement authorities about the issue of piracy.

Beyond these three areas and given that piracy is a cross-border phenomenon, the recommendation enhances cooperation between competent national authorities, as well as between rights holders and intermediaries to ensure a regular exchange of information between administrations on measures in place, challenges and good practices to address online piracy of live events.

At the same time, it also foresees the establishing a stable monitoring system to assess results and to consider further measures; if these are deemed necessary. This robust anti-piracy monitoring system will be supported by the European Observatory on the Infringement of Intellectual Property Rights (EUIPO observatory) and will include the establishment of clear KPIs for effective monitoring.

Piracy in Greece

In this way, the escalation of the fight against such phenomena, it is estimated that the competitiveness of the sports and creativity sectors within the Union will be strengthened and the risks arising from the phenomenon, which is widespread in our country, will be limited.

It is worth recalling that in the case of Greece the number of households that legally watch subscription content; maintaining a subscription to some relevant platform reaches the 1.238.000 according to the global research firm Om Day. In fact, subscription penetration among households is increasing, since it stands at 31% this year from 30% the year before. It should be noted that the specific number does not include the connections of Greek households to the international platforms of Netflix and Disney+, as the latter do not publish their performance for each country separately. However, market players estimate that they amount to approximately 500.000.

Even if we include subscriptions to international platforms, subscription penetration in our country is at much lower levels than many other countries – out of the 15 countries examined by Omdia, 12 have multiple penetration compared to Greece.

Despite this, and while there is room for growth in the market in question, the growth rate of subscriptions in Greece does not exceed 3%. A fact that makes further investments in content prohibitive on the part of the providers, as executives in the field point out.

Especially if you consider that according to the calculations of the providers pirated connections today range from 500.000 to 900.000, again not counting code sharing on international platforms or downloading movies.

The dangers of piracy

The risks deriving from piracy, however, extend far beyond the "brake" that this phenomenon puts on the further development of the market.
