Clarifications regarding the termination / termination of the contract by EETT

ΔIt is clarified that the obligation of the providers not to impose a disconnection fee due to termination / termination of a contract (fixed or mobile telephony) does not apply to fixed-term contracts, but only to indefinite contracts and prepaid connections, as mentioned in the relevant press release. EETT (01 / 10 / 18): "Prohibition of interruption / contract renewal fee: The provider is not allowed to impose a disconnection fee due to interruption / termination of either an indefinite contract or a prepaid telephony connection."

In fixed-term contracts, the subscriber undertakes to stay with his provider for a certain period (eg 12, 18 or 24 months). Therefore, in case it terminates or terminates the contract before the expiration of the specified time, the provider has the right to impose the termination / termination fee. It is noted that, from October 1, 2018, the specific fee must be clearly indicated on the first page of all contracts concluded.

It is pointed out that a subscriber who has a fixed-term contract which he constantly renews, upon its expiration, with a new fixed-term contract, in case he terminates or terminates it before the expiration of the fixed term (of the new contract), will be charged with the fee. termination / termination specified in the new contract.

Relevant examples are given for clarification:

  • Example 1: Subscriber with a fixed-term contract lasting 24 months (for fixed and / or mobile connection), wishes to terminate the contract and cancel his connection in the 20th month. The subscriber will be charged with a contract termination / termination fee, the amount of which is specified in the contract. The same applies if you wish to transfer your connection to a new provider. Also, in case the above subscriber has received equipment with a loan, he must return it or, if he wishes to keep it, pay the relevant fee provided in his contract.
  • Example 2: A fixed-term contract lasting 18 months (for fixed and / or mobile connection) has expired one month ago, without being renewed, and therefore has become indefinite. The subscriber can terminate the contract and cancel the connection, without being charged with termination / termination fee, since the contract has now become indefinite. The same applies if you wish to transfer your connection to a new provider. However, if the subscriber has received equipment with a loan, he must return it or, in case he wishes to keep it, pay the relevant fee provided in his contract.
