GDPR: How to ensure the full protection of personal data in our country.

«The full protection of citizens' personal data is now ensured by the government by submitting to the Parliament the bill for the Protection of Personal Data (GDPR), after the indifference and carelessness of the previous government, which due to a one year delay, led to the imposition of large fines in Greece", Said sources of Megaro Maximos, on the occasion of the submission and voting by the competent committee of the Parliament, of the bill for personal data.

More specifically, from the delayed transposition of the acquis communautaire into national law (Directive 680/2016), it burdened our country with fines totaling 2,5 million euros, while for each day that passes from 07 May 2018 onwards, financial penalties amounting to 5.287,5 euros. Apart from the financial damage, however, citizens to this day remained exposed in terms of securing their personal data, as the previous legal framework was incomplete.

How citizens' rights are protected

Central to the establishment of the Data Protection Officer. This is a person who supervises, monitors and advises each public body or several bodies and the persons who handle privacy for the correct observance of the regulation. The citizen is therefore protected from the outset.

The provisions concerning the Supervisory Authority and its operation, which will supervise the implementation of the new legislation, are also provided in detail.

The new framework allows users to have more control over their personal data, while they can also ask the company to delete them and be informed about the purposes used.

Companies are required to report any breach of their systems (cyber attack), which may jeopardize customers' personal data.

Provisions are also provided regarding:

  • the obligation of the consent of a minor or his / her legal representative, if the minor is under 15 years of age when personal data is processed during the provision of information society services to him / her,
  •  the processing of specific categories of personal data,
  • banning the processing of genetic data for health and life insurance purposes,
  • processing for other purposes by public or private bodies,
  • in the transmission of data by public bodies,
  • the processing of data in the context of employment relations and the strengthening of employee protection,
  •  in data processing in a harmonious relationship with the freedom of expression and information etc.

An important innovation is the consolidation of the principle of accountability, on the basis of which, according to article 45 of the Bill, a form of objective responsibility is established for those in charge of processing, who must prove that they have fulfilled their obligations, ie that they have not done wrong. that they have taken all security measures to prevent the leakage of personal data.

Fierce fines for offenders

There are many organizations and companies that to this day are unaware of the dangers to the rights and freedoms of individuals as they knew that the supervisory authorities did not have the power to impose sanctions on violators.

Under this bill, any company that does not comply will be subject to heavy fines.

The "solution" on websites

The technological development of the internet in recent years provides companies with the ability to collect and process a huge amount of personal data, which multiplies the risks of their violation and makes it necessary to take action. Many websites encourage users to consent to the collection of personal data by them, using vague and "sly" ways resulting in the specific information being promoted for various uses. And this gap is now being filled.

With the incorporation of this directive, the company is obliged to use an understandable and simplified line regarding the collection of personal data, while allowing the visitor to withdraw his consent at any time in case he changes his mind.

Significant benefits for businesses and the state

The bill has significant benefits for both businesses and the state as it puts an end to legal loopholes and uncertainty over the lawful collection, processing, preservation, handling, exploitation and destruction of data. At the same time, it restores the distortions of competition from the asymmetric application of EU rules and a number of parallel national provisions, while helping to balance the right to expression and information, as well as the promotion of economic growth and business activity.

It also paves the way for the reorganization and restructuring of business and public processes while promoting the cultivation and consolidation of a culture of personal data protection of consumers / citizens, employees and suppliers.

Finally, an important element is to create a "competitive advantage" for companies that invest in data security, enhancing their reputation and the trust of their consumers, employees and suppliers.

In summary, the new General Regulation for the Protection of Personal Data:

  • Helps consolidate the value of our personal data. According to estimates, the market value of personal data is estimated to amount to almost Euro1 trillion. in 2020, while by 2025 it is estimated that the volume of data will increase from 16,1 GB to 163 GB
  • Enhances our information on how to properly and legally process our data by companies and the state
  • Facilitates the free and legal circulation of personal data as a means of achieving economic and social progress
  • Clarifies the rules that govern the proper management of our data so that we are better fortified against practices that are not correct
  • It simplifies and protects our daily transactions (online and offline) with companies and the state ".
