Forthnet: Announcement of modification of contractual terms of home services

This is an update of the company Forthnet AE on the modification of the applicable contractual terms of all home programs that include internet access services.


ΣIn this context, the section "SPECIAL TERMS FOR USERS OF INTERNET ACCESS SERVICES (ADSL or VDSL)»Of the applicable contracts of all the above programs (excluding the programs of services provided through satellite network) is replaced as follows:

"The terms of this paragraph apply only if the Subscriber receives internet access services (ADSL or VDSL).

Forthnet implements traffic management measures to the extent and for as long as necessary in order to comply with national or European law and the decisions of judicial and / or administrative authorities, to ensure the integrity and security of its network and of its services. provided through it, to prevent the occurrence of obstacles due to congestion of its network as well as to mitigate the effects of any exceptional or temporary congestion. For the reasons set out above, Forthnet reserves the right to take traffic management measures, provided that they are transparent and non-discriminatory. Traffic management measures, in accordance with the above, do not mean any consumption limits applied in accordance with the terms hereof or measures aimed at reducing the financial risk of Forthnet (temporary interruption of service due to debts of the Subscriber). Any traffic management measure that requires the processing of personal data of the Subscriber is done only for the above reasons or the service of the transaction relationship with the Subscriber.

In addition to the upload and download speeds, crucial parameters for the quality of the service provided and the use of applications and services are the following: the transmission speed (or throughput), the delay, the delay (jitter) and the percentage of packets rejected (packet loss).

The advertised, the maximum, the usually available & the minimum internet connection speed of the service chosen by the Subscriber are reflected in a special appendix called "Appendix of Internet Connection Speed ​​Estimates" which accompanies this contract and is an integral part of it. The measured speed can be affected by various factors, such as parallel traffic from other applications, traffic from other devices within the Subscriber's internal network, Wi-fi connection. For the correct measurement of its speed, the Subscriber must ensure that during the process of carrying out the relevant checks through the tools available from Forthnet the following conditions are met:

  • There is a wired internet connection (via a faulty Ethernet cable) and not via Wi-Fi
  • All applications that use the Internet on the computer are turned off as on any other device using the same Internet connection (eg smart TV, tablet, mobile phone, game console)
  • Other applications have been disabled on the computer performing the measurement (for better operation of the processor and / or RAM)

The Subscriber can proceed to check the speed of the Internet connection through the special application that has been developed by EETT and is hosted on the link www.hyperiontest.gr.

In the event that the Subscriber has selected a contract with a maximum nominal access speed of 24Mbps and after the activation of the service is found a continuous or repeated deviation of the speed in relation to the minimum speed limit, as reflected in the relevant Annex accompanying this contract. Forthnet is obliged to make every effort to correct / improve the speed limit. This can be done, if available, by changing the technology while increasing the nominal connection speed, at a preferential price in relation to the current price list of the additional internet access service. The Subscriber can also terminate his contract without compensation. In any case, if there is a deviation greater than 30% in relation to the minimum speed limit and the necessary actions have been taken to correct the repeated discrepancies between the measured speed and the speed stated in the terms of service, the Subscriber may either downgrade to a connection package without Broadband services or terminate the contract without compensation.

In case the Subscriber has selected a contract with a maximum nominal access speed of 30 or 50Mbps and after the activation of the service is found a continuous or repeated deviation of the speed in relation to the minimum speed limit, as reflected in the relevant Annex accompanying this contract. , Forthnet is obliged to make every effort to correct / improve the speed limit. This can be done, if available, either by increasing the rated speed which may be accompanied by a change of technology, at a preferential price in relation to the current price list of the additional internet access service, or by changing the technology to 24Mbps without degradation fees. In any case, if there is a deviation greater than 30% in relation to the minimum speed limit and the necessary actions have been taken to correct the repeated discrepancies between the measured speed and the speed stated in the terms of service, the Subscriber may either downgrade to a connection package without Broadband services or terminate the contract without compensation.

In the event that the Subscriber has selected a contract with a maximum nominal access speed of 100Mbps and after the activation of the service is found a continuous or repeated deviation of the speed in relation to the threshold of its minimum speed, as reflected in the relevant Annex of his contract, Forth is obliged to make every effort to correct / improve the speed limit. This can be done by changing the technology to 24Mbps without degradation fees. In any case, if there is a deviation greater than 30% in relation to the minimum speed limit and the necessary actions have been taken to correct the repeated discrepancies between the measured speed and the speed stated in the terms of service, the Subscriber may either downgrade to a connection package without Broadband services or terminate the contract without compensation.

Excludes from the correction / compensation policy for deviations set by Forthnet (& described in detail in the paragraphs above) performance discrepancies due to force majeure.

Forthnet may not consider complaints or complaints about deviations when the quality stated in the terms of supply / use & in «Appendix of Internet Connection Speed ​​Estimates»Clearly refers to other environmental and operating conditions, than those described in the Subscriber's complaint or complaint. It is noted that the conditions that must be met for the correct performance of the speed measurement tests through the tool available from Forthnet, are described in detail in paragraph 2.3 hereof.

In case the Subscriber does not accept the proposed remedy or compensation policy set by Forthnet, he is not given the right to file a new complaint, which is covered by the proposed remedy or compensation policy.

The contention ratio of the service is not specific as it depends on a number of factors.2.12. The Subscriber acknowledges that the INTERNET is an open environment, that he is solely responsible for the protection of his personal data, that he must act with utmost diligence taking the necessary security measures to prevent the illegal use of the network, his data codes (username , password) and the Telecommunication Equipment used by third parties authorized or not.

The Subscriber must without delay make frequent changes to the personal password (password) using the service that Forthnet has made available to users on its web pages and still memorize the details of his personal account, not to mention it in objects which transmits or makes accessible to third parties, nor allows the use of its data codes by others.

The Subscriber accepts that, in case Forthnet is obliged to take measures to minimize interference due to the introduction of xDSL technology signals, the broadband services provided to it may be adversely affected, waiving the right to compensation.

FORTHNET E-MAIL ANTISPAMMING SERVICES AND FORTHNET E-MAIL ANTIVIRUS

Value added services Forthnet E-mail Antispamming and Forthnet E-mail Antivirus are provided for security reasons of the final Subscriber, but also for protection of the Forthnet information systems pre-activated (by default ON) with each Forthnet Internet subscription.

The service Forthnet E-mail Antispamming provides the Subscriber with the possibility of personalizing the service and configuring it according to his personal choices.

The Forthnet E-mail Antispamming service is provided in accordance with the specific terms and conditions of the respective Forthnet Antispamming Policy and its respective amendments, as they are published on the corporate website.

The services Forthnet E-mail Antispamming and Forthnet E-mail Antivirus are provided FREE OF CHARGE without prejudice to any legal right of Forthnet to unilaterally modify the terms of provision of the relevant services by informing the Subscriber by any appropriate means and indicatively by posting the content of the contract on the relevant website. The information on the modification of the terms of provision of these services is made cumulatively through the Forthnet website and with reference to a visible point of the printed invoice, or in a relevant form that accompanies the invoice form, or in case no printed invoice is sent, via electronic by the way in which the notification for the issuance of the invoice is made electronically ".

The above amendments shall be made in accordance with the relevant provisions of its decision National Committee of Telecommunications and Posts (Ε.Ε.Τ.Τ.)
