To decide on no. patent 44167/276 / 20.08.2O2O supplementary application of the Collective Protection Organization under the name Company for the Protection of Audiovisual Works (Ε.Π, Ο.Ε.), based on Mesogeion Avenue no. 275, legally represented.
The Commission, having considered the above case and examined the relevant provisions, considered as follows:
1 .Because of no. prot. 44167/276 / 20.08.2Ο2Ο application of a. 66 Law 2121/1993 par. 9 and the relevant printed and digital archives, the Organization for Collective Protection with the name Company for the Protection of Audiovisual Works (EPOE), with headquarters at Mesogeion Avenue no. 275, legally represented, requests the issuance of a new decision due to violation of no. 3/2018 Decision of the present Committee which was taken following the no. prot. 34796/1 / 05.Ο9.2Ο18 application of the Collective Protection Organization under the name Company for the Protection of Audiovisual Works (Ε.Π.Ο.Ε.) and the repetition of the infringement of intellectual property rights and related rights.
2. Because at the 04/09/2020 Meeting of the Committee it was decided to inform the owners and / or administrators of the websites and / or domain names mentioned in the above supplementary application regarding the submitted application, by notifying its body, providing: at the same time, a deadline of five (5) days, according to the letter of par. 9 of no. 66 E of Law 2121/1993, in order for the above owners and / or managers to state their views on the matter.
3. Because the no. 44167/276 / 20.08.2Ο2O application was notified to the owners and / or managers on 1 1 η / Ο9 / 2Ο2Ο, where this became possible, under the information letters / invitations with no. as follows: 44419/278/2020, 44420/279/2020, 44421/283/2020, 44422/280/2020, 44423/281/2020, 44424/282/2020 and 44425/284/2020.
4. Because from the above recipients, opinions were submitted exclusively by Mr. Papadopoulos, allegedly the administrator of the website with domain name subs4series.com, on time, ie on 18/09/2020 and with a submission time of 10:45 PM (no. patent 44527/285 / 16.09.2Ο2Ο). Specifically, the signatory of the above report claimed that the site with the domain name subs4series.com is not related to and does not redirect to the site with the domain name subs4free.info.
5. For the above (under 4) case it appears, after the relevant research, that the site with the domain name subs4series.com does not redirect to the site with the domain name ) https://www.subs4free.info. Therefore, according to the relevant allegation of the applicant, there is no violation, as it concerns the no. 3/2018 decision of the Commission for the Internet Infringement of Intellectual Property, with the result that it becomes rejected in this regard.
6. Because in the present case, after the study of the data of the file and of no. 3 to 14 Related to the above supplementary application, and after the completion of the relevant investigation by the Commission, the following emerges:
i) The site with the current domain name xrysoi.net, and the domain names xrysoi.tv and tainiesonline.org, which are active and redirect to it, is identical to website which was made accessible through the domain name xrysoi.online, the access interruption of which has been judged under no. 3/2018 of the Commission Decision, for the reasons mentioned in it,
ii) The site with the current domain name gamatotv2.com, and the domain names gamatotv1.com, gamatotv3.com, gamatotv.co, gmtv.me, and gamatokid.com which are active and redirect to it, identifies with the site which became accessible through the domain name gamatotv.me, the access interruption of which has been judged under no. 3/2018 of the Commission Decision, for the reasons mentioned in it,
iii) The site with the current domain name teniesonline.club is identical to the site which was made available through the domain name tenies-online.com, the access termination of which has been decided by of no. 3/2018 of the Commission Decision, for the reasons mentioned in it,
iv) The site with the current domain name oipeirates.tv is identical to the site which was made accessible through the domain name https://oipeirates.online, the access termination of which has been decided pursuant to no. Commission Decision 3/2018, for the reasons stated therein,
v) The site (domain) with the current domain name (domain name) tainiomania.co is identical with the site which was made accessible through the domain name (domain name) tainio-mania.com, the access interruption of which has been judged by no. 3/2018 of the Commission Decision, for the reasons mentioned in it,
vi) The site with the current domain name liomenoi.me, and the domain name liomenoi.online, which is active and redirects to it, is identical to the site that was made accessible via of the domain name (domain name) liomenoi.com, the access interruption of which has been judged under no. 3/2018 of the Commission Decision, for the reasons mentioned in it,
vii) The site with the current domain name magico.one is identical to the site which became accessible through the domain name magico.info, the access interruption of which has been judged under No. 3/2018 of the Commission Decision, for the reasons mentioned in it,
viii) The site (domain) with the current domain name subs4free.info, and the domain names sf4-industry.com and subs4free.com, which are active and redirect to it, is identical to site which was made accessible through the domain name (domain name) subs4free.com, the access interruption of which has been judged under no. 3/2018 of the Commission Decision, for the reasons mentioned in it,
ix) The site with the current domain name subztv.online is identical to the site which was made accessible through the domain name subztv.club, the access interruption of which has been decided under No. 3/2018 of the Commission Decision, for the reasons mentioned in it,

Because all the relevant documents submitted by the applicant show the similarity of the database, in terms of structure and content, the use of identical graphics, user interface and indexing on each site, and thus again a violation of copyright and of related rights, as it was judged by no. 3/2018 Decision of the Commission.
8. Because the operation of those mentioned in no. patent
9. Because the site with the domain name subs4series.com does not redirect to the site with the domain name https://www.subs4free.info.
FOR THOSE REASONS
Accepts the request in part.
Orders that within forty eight (48) hours from the notification of the present, the access to the internet users by the companies - providers, which have been legally licensed and are legally registered in the relevant Register of Providers of Networks and Electronic Communications Services of EETT to the following domain names and specifically:
