Apple fined $19m in Brazil for continuing to sell iPhones without chargers

Court in Brazil imposed a fine 19 million dollars to Apple, "as social compensations" for selling iPhones without a charger, as it states Reuters


The court of the State of São Paulo pointed out that Apple is obliged to offer chargers inside the packaging of iPhones sold in the country. The court ruled in favor of the action brought by the association of borrowers, consumers and taxpayers of Brazil (AMBCC).

Apple has claimed that it has stopped offering chargers in iPhone packaging in order to reduce carbon emissions, while maintaining that many users already have enough chargers on hand. However, if one needs a charger, the company continues to sell the chargers separately.

The court presiding over the case did not accept Apple's environmental suggestion, and as stated in the decision it issued, it emphasizes that:

It is obvious that Apple, under the pretext of a "green initiative", is forcing the consumer to buy the chargers that were previously supplied completely free with iPhones.

In addition to the fine, the court orders Apple from now on to sell the iPhones along with the chargers, but also to provide the chargers completely free of charge to all Brazilians who bought the company's products after the October 13 2020.

Apple stopped providing chargers to iPhones when it launched the iPhone 12 models in 2020, and since then the company no longer ships iPhones or EarPods with chargers in most countries, but simply offers a USB-C to Lightning cable in the box .

Last September, Brazil's Justice Ministry ordered Apple to stop selling iPhones without the charger and also fined it $2,34 million, alleging that Apple was giving its customers an incomplete product.

Apple did not comply with this court order and appealed the ruling issued by the Brazilian Ministry of Justice last September, and it also plans to file a new appeal against today's decision by the court in Sao Paulo.
